Nonprofit Donation Information

Simply put.
A non profit would receive 20% of Nathan Caldwells commissions on the sale of a home. For example, 20% of a realtor’s commission on a $650,000 house comes out
to about $3,000 for your non-profit.


How does it work?
Nathan will provide gift cards to the leaders of your non-profit. Which can be handed out. Emailed or Saved in a desk drawer collecting dust.

But when someone in your non profits network wants to buy a house. You dig up that card (or ask Nate to send you another one) and give it to them. Do an introductory group text or email and Nathan will help them to buy or sell their home then Your Nonprofit receives a check in the mail.

At closing, the title company will write a check to your non-profit. The legal side of this has been written up by a real estate attorney and is found through the QR code on the back of the card (it will bring you back to this page and scroll down to the bottom).

Benefits to your non-profit.
1) A check for non-earmarked funds that resulted without asking your donors for additional funds. There is no additional cost to the homebuyer or seller. No additional expense in advertising or time is expected.
2) People within the non-profit’s network are buying homes, so having a sense of strengthened community because the house sale helped the non profit is an added bonus.

Why would Nate give away so much of his commission?
1) Most real estate agents spend 10% of their commissions on advertising, and instead of doing that, Nathan Caldwell is growing his network with word of mouth by supporting non-profits instead of giving that money to Facebook.
2) This is only for non-profits that Nathan has worked with in the past and wants to benefit. Nathan has a direct connection with your group and wants to support it.

If acting as Buyer’s Agent:

Buyer Agency Agreement additional provisions:

If, and only if, the following condition is met, Broker will donate $ of Broker’s commission (“Donation”) at Closing of <<property address>> (the “Property”) to <<Charitable Organization>> , a 501(c)(3) charitable organization (“Charitable Organization”): Broker is paid the cooperating commission indicated in the MLS as a result of Buyer’s closing of the purchase of the Property. Broker has an affiliation with Charitable Organization; however, the Donation to Charitable Organization will in no way provide any form of financial or other benefit whatsoever to Broker (except for any potential federal and state tax deductions claimed by Broker as a result of the Donation) or to Modus Real Estate, LLC (“Modus”). The Donation is not a credit or rebate to the Buyer or Seller; and the Donation has no cash value to Buyer or Seller.  Upon Closing of the Property, the Donation will be paid by and from Broker (and not Modus) to the Charitable Organization. Any federal or state tax benefits earned as a result of Broker donating the Donation to the Charitable Organization shall inure to the benefit of Broker and not to Buyer, Seller, or Modus.  Modus makes no representations or warranties whatsoever concerning the Donation or the Charitable Organization.               

If acting as Listing Agent:  

Listing Agreement additional provisions:

-At Closing, Seller’s Broker will donate $ of Seller’s Broker’s commission to <<Charitable Organization>> , a 501(c)(3) charitable organization (“Charitable Organization”). Broker has an affiliation with Charitable Organization; however, the aforementioned donation to Charitable Organization will in no way provide any form of financial or other benefit whatsoever to Broker (except for any potential federal and state tax deductions claimed by Broker as a result of the Donation) or to Modus Real Estate, LLC (“Modus”).  The Donation is not a credit or rebate to the Buyer or Seller; and the Donation has no cash value to Buyer or Seller.  Upon Closing of the Property, the Donation will be paid by and from Broker (and not Modus) to the Charitable Organization. Any federal or state tax benefits earned as a result of Broker donating the Donation to the Charitable Organization shall inure to the benefit of Broker and not to Buyer, Seller, or Modus.  Modus makes no representations or warranties whatsoever concerning the Donation or the Charitable Organization.

Upon Mr. Caldwell’s successful representation of a buyer or seller who completes the purchase or sale of real property in the State of Colorado, Mr. Caldwell may donate a portion of his commission earned (the “Donation”) to one of the following 501(c)(3) charitable organizations:

Notwithstanding the foregoing, Mr. Caldwell reserves the right to determine, in Mr. Caldwell’s sole and subjective discretion, the Donation’s recipient, so long as such recipient is a 501(c)(3) charitable organization in good standing with all applicable jurisdictions. Mr. Caldwell may have an affiliation with the recipient of the Donation; however, the Donation will in no way provide any form of financial or other benefit whatsoever to Mr. Caldwell (except for any potential federal and state tax deductions claimed by Mr. Caldwell as a result of the Donation) or to Modus Real Estate, LLC (“Modus”).  The Donation shall not be construed as a credit or rebate to the Buyer or Seller; and the Donation has no cash value to Buyer or Seller.  Any Donations made to a qualifying charitable organization will be paid by and from Mr. Caldwell (and not Modus). Any federal or state tax benefits earned as a result of any Donation made to a qualifying charitable organization shall inure to the benefit of Mr. Caldwell and not to Modus or anyone else. Final terms and conditions of the Donation and the Donation’s recipient shall be memorialized in an executed agreement between Mr. Caldwell and the buyer or seller, and until such time, Mr. Caldwell shall be under no obligation to make any Donation to any party.  Mr. Caldwell reserves the right to modify or cancel this Donation promotion at any time.
